The Collaborative Law Approach

Collaborative Law is a reasonable, effective, legally recognized way for clients to work cooperatively with trained professionals to achieve binding solutions respectfully, without going to court.

Collaborative Law offers a non-adversarial, problem-solving approach to resolving legal disputes. Collaborative attorneys are specially trained to facilitate win/win settlements. Most of the work is done in four-way meetings with both clients and both attorneys together at one table. Each client has the support, protection and advice of his or her own Collaborative lawyer.

    Benefits of Collaborative Law include:
  • non-adversarial, confidential structure for resolving important legal issues
  • guidance of attorneys trained and experienced in helping everyone involved to stay reasonable
  • control of both process and outcome by those involved
  • binding, enforceable settlements which are respected by the judicial system
  • focus on needs and interests of parties and others affected
  • maintenance of privacy regarding sensitive matters
  • avoidance of expensive discovery process
  • less expense than in litigation for most clients

Collaborative Law differs from mediation chiefly by the participation of the attorneys, who have the expertise, experience and authority to advise on legal matters, however complex, and to complete the legal process once agreement is reached. As in mediation, the Collaborative Law process is designed to reach mutually supported settlements.

Collaborative Law is applicable in a variety of legal areas and for a variety of clients. Please contact us if we can answer any questions.
